It was a car accident case.
I knew the other driver went through a red light.
I also knew that if I confronted the other driver head on, and accused him directly of going through the red light, he'd deny it.
He'd get defensive.
He'd get offended and shut down giving me any useful information.
"Hey Mr. Jones, isn't it true you went through the red light?"
If he says "No," I'm stuck with that unfavorable answer.
No matter how many times I try to undo his answer of 'no', it's still going to be 'no'.
"Are you sure the light was green when you went through it?"
"How do you really know the light was green for you?"
"Are you absolutely certain the light wasn't red when you went through the intersection?"

Instead, I took a different approach.
It had nothing to do with directly confronting this witness.
Rather, it had everything to do with breaking down, moment by moment, what small steps he took.
Literally, every single thing he did.
From getting his keys, to opening the door, to entering his car, to adjusting the mirror, to adjusting the seat, to putting on the seatbelt, to turning on the engine, to putting the car in gear, to what road he was on, what direction of travel he was going to go, to what the traffic was light and whether the road was one way or two way.

Then, if needed, I can break each of those down further.
Oh, by the way, I need to ask him about the rules of the road too.
Is he familiar with the rules of the road.
What's a red light?
What is a yellow light?
What is a green light.
Ask him about speed limits and what happens if a driver goes over the speed limit.
What happens if a driver were to go through a red light? What could happen?
And on and on.
