The Employment-Based Second Preference National Interest Waiver Visa (EB2-NIW) is an exceptionally popular mechanism for professionals to obtain residency in the US -- and for good reason. Despite efforts by the Trump Administration to curtail immigration in many other ways, the NIW continues to have an extremely high approval rate overall. With no employer sponsor required and with standard processing times dropping well under a year this path has become extremely attractive to many professionals.

However, over the last several months we have noticed several patterns creating issues with approvals of NIWs or leading to Requests for Evidence at the very least. While we have been fortunate to have not received a denial of a NIW during 2020 we have had to refile several Petitions for new clients whose prior representation lacked the diligence, creativity or sometimes the basic competence necessary to obtain approval.

After seeing several EB-2 National Interest Waiver denials based on the same patterns we felt it best to lay out a video diagnosing the most common mistakes we see on a daily basis in evaluating and filing NIW Petitions.
