If you've been charged with a case or if you're in any way participating in a criminal case, you may hear the term discovery used. And a lot of people wonder what that means. What is discovering what does that mean, for my case, discovery is just a very general term that encompasses any evidence that the state or the prosecutor is using against you. So often what we see in criminal charges is the discovery will have all the police reports, it will have all of the body worn camera evidence, it will have witness statements, it will have their surveillance video or 911 Call, or any kind of video of the event. That's what discovery is, the state is required to give your defense attorney absolutely everything that they have against you, so that we can prepare a proper defense to whatever they have. So when we say we're waiting on Discovery, or we're requesting discovery, what that means is that we as your attorney are reaching out, asking for every single piece of evidence is going to be used against you because we have the right to see it well before anything happens with it. So what that means is, if we have to go to trial, we already know exactly what the state is bringing in. And the reason I bring that up is a lot of the times in the TV shows like Law and Order, you'll see people walk into court waiting some new piece of evidence, and the prosecutor will say, and then there's this smoking gun I found last night while I was asleep. That's not how it goes. In the real world, we have the right to see absolutely every single thing that the prosecution has against you well in advance. And if they pulled some shenanigans like that walked into court last minute, with some huge piece of evidence, we have a pretty good chance of getting your case thrown out because that is not legal in the state of Colorado, we have the right to see all of that effort and all of that discovery. And that means every single piece that the prosecutor could or could not, I mean, basically anything that they have against you, we get to see that. So that's what discovery is, is everything that's going to be used against you. And then make sure that if you have a criminal defense attorney, you have access to that discovery, because you're the one being charged you have the right to see everything that they're bringing into and make sure you have an attorney or a firm that will give you all that evidence and make sure that you have time to review it at your own pace Have you fully understand what is being brought against you
