Why do we need to understand property principles to study the other parts of the common law? Professor Donald Kochan explains that property, contracts, and torts are all about individual rights and the responsibilities of people to each other. Whereas property is about the right to exclude others from things you own, torts is similarly about the right to exclude others from your person.

Donald Kochan is Professor of Law at George Mason University Antonin Scalia Law School and Deputy Executive Director of the Law and Economics Center.

As always, the Federalist Society takes no position on particular legal or public policy issues; all expressions of opinion are those of the speaker.
