An Affidavit of Support sponsor is required to provide financial assistance at 125% of the federal poverty line - but what if they claim to have no money? Even in that situation, there are at least 5 reasons you might want to sue. (1) You don't know what their financial situation is before completing the discovery process in a lawsuit. (2) You may have a "co-sponsor" who is also liable on an Affidavit of Support. (3) Sponsors often get loans or find other ways to come up with money after they have been sued. (4) You may want to bring your claim to ensure that it is not later found to be time barred, and judgments under the I-864 have been determined to be exempt from bankruptcy protections. (5) Starting your lawsuit is financially low-risk, if you use a firm like ours that does not charge out-of-pocket legal fees.
