Filing a motion to compel arbitration can move a case from court to a private arbitration setting. This move can be beneficial if the cost of arbitration for the creditor outweighs the debt value, and in some cases, may lead to a case dismissal. However, arbitration can be costly as the arbitrator's fees are typically shared by both parties. The process of arbitration is similar to a court trial but without a jury option and is often more informal.

Arbitration might be a viable strategy for debts under $20,000 to $30,000, as the costs might deter the creditor from proceeding. Contract terms influence who pays the arbitration fees, so if your arbitration clause states that you would be responsible for arbitration costs, then it probably isn't your best option.
