Supreme Court Justice Stephen Breyer, 83, plans to retire from the court, the PBS NewsHour and other outlets have confirmed. In a September 2021 interview with anchor and managing editor Judy Woodruff, Breyer addressed how and when he plans to retire from the high court. "I don't want to die on the court. Before then, I would like to retire. And just when that will be, I have not fully decided." He added that he had "looked at what people have done in the past," including other Supreme Court justices.

The vacancy will give President Joe Biden his first opportunity to nominate a justice for the high court. Breyer, appointed by former President Bill Clinton, has been on the bench since 1994. Both he and the late Justice Ruth Bader Ginsburg chose not to step down during Barack Obama’s presidency, when Democrats last controlled both chambers of Congress. The Senate ultimately will vet and vote on whether to confirm the nominee.
