What Happens if You REFUSE to Turn Over Your Income Records During Your Medical Malpractice Case?

You sued your doctor for malpractice.
For being careless.
For causing you harm.
For causing you permanent injury.

In addition to your physical injuries, you claim that you've been unable to work.
You have not been able to return to your job that you held for many years.
Your doctors have told you that it's unlikely you'll ever be able to work again.

You're upset.
You're devastated.
You're angry.

After your attorney confirms that you have a valid case and starts your lawsuit, you learn that because you've been out of work since this incident and because you won't be able to work in the future, he has included a claim of lost earnings and loss of earning capacity in your behalf.

You appreciate that he included that claim, but you're a very private person.
You don't want anyone knowing how much you were earning before.
You don't want friends, family or strangers learning how much you earned.
The more you think about it, you decide to tell your attorney that you will not turn over any income records, income tax records or W2 forms to confirm what you were earning for a few years before you suffered injury.

The defense says they need those records to validate and confirm your income loss.
If you refuse to turn over your income records can you still maintain a claim for loss of income and lost earning capacity?
